Switzerland Simplifies Cross-Border Legal Hearings via Videoconference

Effective January 1, 2026, Switzerland has implemented a reform to facilitate the hearing of Swiss residents by foreign courts through videoconferencing in civil and commercial proceedings.

Abolition of Prior Approval

The previous requirement for prior approval from the Federal Office of Justice has been replaced with a notification system. Foreign courts must now notify Swiss authorities at least fourteen days before the scheduled hearing, including a statement of consent from the individual concerned.

Consent and Confidentiality

Individuals must consent to be heard via videoconference, with the option to withdraw consent at any time. The reform maintains confidentiality obligations to protect sensitive information during proceedings.

This change aims to streamline cross-border legal processes while safeguarding the rights and privacy of individuals involved.
