On March 17, 2026, the Republic of Tajikistan enacted a significant amendment to its Code of Execution of Criminal Penalties, introducing changes aimed at enhancing the efficiency and clarity of the country's penal system.
The amendment specifically modifies Part 2 of Article 31 of the Code. The newly added provision states:
"If the sentence is carried out out of the territory of activities of the court which pronounced sentence, the contractor of body of execution directs submission on the questions connected with execution of sentence to the court of the same name."
This addition addresses scenarios where a court's jurisdiction does not encompass the location where a sentence is to be executed. In such cases, the responsibility for matters related to the execution of the sentence is transferred to a court of equivalent status within the appropriate jurisdiction.
This legislative change is expected to streamline the execution of sentences by ensuring that jurisdictional boundaries do not impede the enforcement of judicial decisions. By delegating execution-related matters to the appropriate local courts, the amendment aims to enhance the responsiveness and effectiveness of the penal system.
The amendment was accepted by the Resolution of the Majlisi Namoyandagon (Lower House of Parliament) on January 21, 2026, and approved by the Resolution of the Majlisi Milli (Upper House of Parliament) on February 6, 2026. The law was officially enacted on March 17, 2026, following its publication.
This amendment is part of a broader effort by Tajikistan to reform its legal and judicial systems. Recent initiatives have focused on improving the efficiency of legal processes, ensuring the protection of human rights, and aligning national legislation with international standards.
The enactment of this amendment marks a significant step in Tajikistan's ongoing legal reforms. By addressing jurisdictional challenges in the execution of sentences, the amendment contributes to a more efficient and effective judicial system, ultimately enhancing the rule of law in the country.
