The Supreme Court of Palau has denied an emergency request by the Senate and two citizens to halt the implementation of a migration agreement with the United States. The agreement, signed on December 24, 2025, by President Surangel S. Whipps Jr., allows for the potential transfer of up to 75 third-country nationals from the U.S. to Palau, subject to case-by-case approval.
In a 29-page order issued on February 17, 2026, the court ruled that the plaintiffs failed to demonstrate the necessary legal standards for a temporary restraining order. The judge emphasized that the plaintiffs did not provide sufficient evidence of immediate harm, noting that their claims of potential damage to the "social fabric" and public confidence were speculative and unsupported.
The court also addressed the Senate's argument that the Memorandum of Understanding (MOU) constitutes a treaty requiring legislative ratification. It found that the MOU appears nonbinding and framed in discretionary language, indicating that it does not create enforceable legal obligations under domestic or international law.
While the court expressed some concern about potential conflicts between the MOU's implementation and existing immigration regulations, it concluded that the plaintiffs did not make a strong enough case to justify the "extraordinary and drastic" remedy of a preliminary injunction.
This ruling allows the Executive Branch to proceed with the MOU's implementation, subject to existing laws. However, the underlying lawsuit, which alleges 17 separate legal violations, will continue.
This decision underscores the judiciary's role in balancing executive actions with legislative oversight. By denying the injunction, the court has set a precedent that nonbinding agreements, such as MOUs, may not require legislative ratification if they do not impose enforceable obligations.
