Montserrat Court Denies Dismissal of Human Trafficking Charges

The Montserrat High Court has denied a motion to dismiss 18 human trafficking charges against Crawford Sabaroche, a Dominican national accused of smuggling 18 people into Montserrat. Sabaroche argued that his rights were violated due to being remanded without a warrant and not being brought before the Magistrate’s Court within 72 hours of being charged.

Justice Dale Fitzpatrick ruled that, even if there were technical violations, Sabaroche did not demonstrate any prejudice resulting from them. The judge emphasized that dismissal of charges should be reserved for the most serious breaches of an accused's rights.
