The European Union's top court has ruled that Poland must recognize same-sex marriages registered in other EU countries, even though Polish law does not currently allow such unions. The decision was prompted by a case involving a Polish couple who were married in Berlin in 2018 and sought to have their marriage recognized after returning to Polandan appeal that Polish authorities rejected. The Court of Justice of the European Union stated that denying recognition breaches EU rights concerning freedom of movement and family life. While this ruling does not compel Poland to legalize same-sex marriage domestically, it obliges the government to acknowledge valid same-sex marriages from other EU states. LGBTQ+ advocates and allies herald the decision as a step toward equality. However, implementation may face hurdles from conservative political factions and President Karol Nawrocki, who holds veto power. The government recently introduced a proposal for limited legal rights for same-sex couples, but its future remains uncertain.
