The Spanish government anticipates that the agreement between the European Union and the United Kingdom concerning Gibraltar will be ready for provisional application by April 10, 2026. Fernando Sampedro, Secretary of State for the European Union, expressed optimism from Brussels, despite acknowledging that Spain cannot guarantee the exact timelines within the EU's internal processes.
The agreement, which complements the post-Brexit legal framework, still requires approval from both the Council and the European Parliament, processes that may introduce delays. To expedite its implementation, efforts are underway to apply the agreement provisionally, pending the Council's approval.
A key aspect of the treaty, finalized in December, is the removal of the physical border fence between Gibraltar and Spain. This change depends on an implementation plan that must be agreed upon by both Spain and the United Kingdom. Discussions on this plan are reportedly in advanced stages, though specific details have not been publicly disclosed by the Spanish Ministry of Foreign Affairs or the British Foreign Office. The European Commission, which forwarded the legal texts in February, also supports the provisional application while institutional procedures continue.
The agreement aims to facilitate mobility and cooperation between Gibraltar and Spain, addressing concerns related to border controls and economic integration post-Brexit. However, sectors such as Andalusian tobacconists have raised alarms about potential increases in tobacco smuggling due to tax disparities between Gibraltar and Spain, highlighting the need for careful implementation to mitigate unintended consequences.
As the April 10 deadline approaches, all parties involved are working diligently to finalize the necessary steps for the agreement's provisional application, marking a significant milestone in Gibraltar's post-Brexit relationship with the European Union and Spain.
