On April 7, 2025, the ECOWAS Community Court of Justice delivered its judgment in Case No. ECW/CCJ/APP/38/23, dismissing a claim against the Republic of Cape Verde alleging violation of the right to health.
The case involved Mr. Lacerda Yoann, a Cape Verdean citizen with a hereditary immune disorder requiring specialized medication. Due to COVID-19 travel restrictions, he faced challenges in importing his medication and alleged that the state impeded his access to necessary health services.
The court found that Cape Verde had authorized the importation of the medication and provided clear guidance on the required hospital-based procedures. Consequently, the court concluded that there was insufficient evidence to establish a violation of the right to health attributable to the state.
