On January 12, 2026, the High Court of Zambia inaugurated its criminal sessions with a strong emphasis on integrating Alternative Dispute Resolution (ADR) mechanisms, particularly plea bargaining, to enhance the efficiency and fairness of the judicial process.
The opening ceremony, themed "Consolidating the Call for Proper Use of Alternative Dispute Resolution Through Plea Bargaining," highlighted the judiciary's commitment to modernizing criminal litigation. Deputy Chief Justice Michael Musonda, SC, underscored the urgent need for national sentencing guidelines, noting that Zambia lags behind smaller jurisdictions in this regard.
Justice Minister Princess Kasune, MP, reaffirmed the government's dedication to justice sector reforms, emphasizing the importance of clear procedures and safeguards in implementing plea bargaining to prevent potential abuses. She announced that the Ministry of Justice is reviewing the Criminal Procedure Code to empower the Chief Justice to issue official sentencing guidelines.
The adoption of ADR and plea bargaining is anticipated to reduce case backlogs, expedite the resolution of suitable cases, and create a more predictable and fair judicial system. This initiative aims to protect the rights of both victims and the accused by delivering timely justice.
