North Macedonia Constitutional Court Declines to Review Labor Law Article

On November 26, 2025, the Constitutional Court of the Republic of North Macedonia decided not to initiate proceedings for reviewing the constitutionality of Article 104-a of the Law on Labour Relations.

The decision came after receiving initiatives from multiple individuals and legal representatives challenging the article's constitutionality. The court, composed of President Darko Kostadinovski and judges Naser Ajdari, Tatjana Vasi07-Bozadêeieva, Jadranka Dabovi07-Anastasovska, Osman Kadriu, Dobrila Kacarska, and Ana Pavlovska-Daneva, concluded that there were no sufficient grounds to proceed with a constitutional review of the contested provision.

This resolution indicates the court's position that Article 104-a of the Law on Labour Relations does not warrant constitutional scrutiny at this time, leaving the existing legal framework unchanged.
