Court to Hear Kamikamica's Bid to Overturn FICAC Commissioner's Appointment

The High Court in Suva has scheduled a hearing for March 25, 2026, to consider former Deputy Prime Minister Manoa Kamikamica's application challenging the appointment of Lavi Rokoika as Commissioner of the Fiji Independent Commission Against Corruption (FICAC).

Mr. Kamikamica, represented by his lawyer Wylie Clarke, argues that the appointment process was fundamentally flawed due to the alleged exclusion of the Judicial Services Commission (JSC) from the decision-making process. He contends that any actions undertaken by Ms. Rokoika under this appointment are therefore null and void, including the charges filed against him.

During the court session, Mr. Clarke informed Justice Warleen George that all necessary paperwork had been filed at the Civil High Court Registry and that they were prepared to proceed. The court has directed FICAC to file its reply to Mr. Kamikamica's application by January 14, with Mr. Kamikamica required to respond by February 4. All written submissions from FICAC must be filed by February 25, ahead of the hearing date.

This case raises significant questions about the legality of appointments to key governmental positions and the potential implications for ongoing and future legal proceedings initiated by FICAC. The outcome could have a profound impact on the integrity and functioning of anti-corruption efforts in Fiji.

As the hearing date approaches, both parties are expected to present comprehensive arguments regarding the validity of the appointment process and its consequences. The public and legal community will be closely monitoring the proceedings, given the potential ramifications for governance and the rule of law in the country.
