The French Competition Authority has imposed a fine of €148,094 on BTP Sud for abusing its dominant position in the aggregates supply market in Wallis and Futuna. The company was found to have refused sales and imposed unjustified price increases on the Administration Supérieure du Territoire, aiming to obtain concessions related to a previous commercial dispute.
BTP Sud operates the only quarry in Wallis and Futuna capable of meeting local demand, granting it a dominant position in the aggregates supply market. The Administration Supérieure du Territoire, responsible for public works, relies heavily on BTP Sud for materials.
In 2018, the Administration awarded BTP Sud a contract for road construction, valid for one year and renewable until July 2022. A dispute arose over late payments under a separate 2015 contract. In June 2021, BTP Sud unilaterally terminated the 2018 contract, citing COVID-19-related closures, and halted deliveries to the Administration while continuing to serve private clients.
In February 2022, BTP Sud imposed a 75% price increase on the Administration without economic justification. Evidence indicated that these actions aimed to pressure the Administration into settling the 2015 dispute.
The Authority determined that BTP Sud's conduct constituted an abuse of a dominant position by imposing unfair trading conditions, violating Article L. 420-2 of the French Commercial Code. The €148,094 fine reflects the severity of the infringement and serves as a deterrent against similar practices.
This case underscores the importance of fair competition practices, especially in markets with limited suppliers. The ruling aims to protect public institutions from exploitative practices and ensure the efficient use of public funds in Wallis and Futuna.
