High Court Dismisses Contempt Application in Land Dispute

On March 6, 2026, the High Court of Uganda delivered a ruling in the case of Busulwa Sylvia v Ssengendo Godfrey and Others (Miscellaneous Application No. 9 of 2025). The case centered on allegations of contempt of court in a land dispute.

The applicant, Busulwa Sylvia, accused the respondents of willfully breaching a clear injunction related to the disputed land. She sought the court's intervention to hold the respondents in contempt.

After reviewing the evidence, the court found that the applicant failed to provide compelling proof that the respondents had deliberately violated the court's order. Consequently, the contempt application was dismissed.

The judgment highlighted the stringent requirements for proving contempt of court, emphasizing that clear and unambiguous evidence is necessary to establish such claims. The court also noted the importance of using contempt powers sparingly and as a last resort.

This ruling serves as a reminder of the high burden of proof required in contempt proceedings and underscores the judiciary's cautious approach in exercising contempt powers.
