Supporters of Former Malaita Premier Welcome High Court Ruling

Supporters of former Malaita Province Premier Daniel Suidani have welcomed the High Court ruling in favor of Suidani, delivered in Honiara on Thursday. High Court Justice Maelyn Bird declared that the removal of Suidani on March 20, 2023, based on the letter from former Minister of Provincial Government and Institutional Strengthening, Rollen Seleso, was unlawful.

The court found that the procedures followed in the removal did not comply with the legal requirements set out in the Provincial Government Act. Specifically, the court noted that the Minister's directive lacked proper consultation with the Malaita Provincial Assembly and did not adhere to the principles of natural justice.

In response to the ruling, Suidani's supporters gathered in Auki, the provincial capital, to celebrate the decision. They expressed hope that the ruling would lead to greater respect for the autonomy of provincial governments and adherence to legal procedures in governmental actions.

The ruling has sparked discussions about the balance of power between national and provincial governments in the Solomon Islands. Legal experts have emphasized the importance of following due process and ensuring that any actions affecting elected officials are grounded in law.

The government has yet to announce whether it will appeal the decision. Meanwhile, the ruling is seen as a significant affirmation of the rule of law and the rights of provincial leaders.
