The European Court of Justice (ECJ) has imposed a €1.59 million fine on Bulgaria for failing to transpose a 2019 directive on clean and energy-efficient road transport vehicles into national law. The directive required EU member states to implement necessary laws by August 2, 2021, a deadline Bulgaria missed.
After the deadline passed, the European Commission (EC) sent a formal notice to Bulgaria on September 29, 2021, reminding the country of its obligations. Bulgaria cited pre-existing national legislation and challenges posed by the COVID-19 pandemic as reasons for the delay. However, the EC argued that Bulgaria did not demonstrate a specific link between the pandemic and the transposition delay, noting that other member states had complied within the timeframe.
The ECJ upheld the EC's arguments, resulting in the financial penalty and an order for Bulgaria to cover court costs. This ruling emphasizes the necessity for EU member states to adhere to directive transposition deadlines to avoid legal and financial repercussions.
