Prime Minister Philip Davis addressed the House of Assembly regarding the recent arbitration ruling between the Government of The Bahamas and the Grand Bahama Port Authority (GBPA). The ruling confirmed GBPA's obligation to make annual payments to the government until 2054, as stipulated in the Hawksbill Creek Agreement. This decision reinforces the government's authority over licensing, immigration, customs, utilities, land purchases, and environmental approvals within the Port Area.
The arbitration was initiated to resolve longstanding disputes over the governance and financial responsibilities of the GBPA. The government sought to ensure that the Port Authority fulfilled its contractual obligations, including financial contributions and adherence to national laws.
This ruling is seen as a significant step toward ensuring that Freeport operates under the same legal framework as the rest of The Bahamas. It emphasizes the government's commitment to equitable governance and the enforcement of national laws within all jurisdictions.
The government plans to invoke the review mechanism for future years to determine the exact amounts owed by GBPA. Additionally, efforts will be made to regularize and approve environmental by-laws to ensure sustainable development within the Port Area.
Prime Minister Davis emphasized the importance of this ruling in affirming the rights of Bahamians in Freeport to participate in decisions affecting their lives and ensuring that private interests do not supersede national sovereignty.
