On February 26, 2026, Chief Justice Luke Malaba issued Practice Direction 1 of 2026, aimed at standardizing the use and application of specific legal terms within Zimbabwe's Magistrates' Courts. The Practice Direction focuses on the proper use of the terms 'Struck off the roll,' 'Postponed sine die,' and 'Removed from the roll.' According to the directive:
- 'Struck off the roll' is to be used exclusively for matters that are fatally defective and should not have been enrolled in their current form. Such defects must be fundamental, rendering the case incapable of proceeding.
- When a matter is struck off due to a party's failure to comply with court rules, the non-compliant party has 30 days to rectify the defect. Failure to do so will result in the matter being deemed abandoned, and the clerk of court must present it before a magistrate for dismissal.
- For matters 'postponed sine die' or 'removed from the roll' that are not reinstated within three months, they will be considered dormant and regarded as abandoned. These cases must also be placed before a magistrate for dismissal.
