Legal Services Act to Be Fully Commenced 1 January 2026

The Cayman Islands is set to implement the remaining provisions of the Legal Services Act, 2020, along with five supporting regulations, on 1 January 2026. The Act is designed to:

One of the supporting regulations, The Legal Services (Professional Development) Regulations, 2025, introduces several initiatives aimed at supporting Caymanian attorneys:

  • Establishment and maintenance of scholarship programs for Caymanians.
  • Mandatory interviews for articles of clerkship for scholarship students meeting specific criteria.
  • Offering associate positions to articled clerks who successfully complete their clerkship and apply to the firm.
  • Development of training programs for articled clerks.
  • Assignment of mentors to newly qualified attorneys employed by the firm.
  • Provision of overseas employment opportunities for Caymanian attorneys.

Financial Implications

The Legal Services (Fees) Regulations, 2025, set out the practicing certificate fee for attorneys, the annual operational licensing fee, and other administrative fees. These are expected to generate approximately KYD$8.6 million in public revenue in 2026.

Implementation Timeline

The Order to commence the Legal Services Act and its regulations was approved by Cabinet on 13 November 2025. Firms practicing Cayman Islands law immediately before the Act's commencement have a six-month period from 1 January 2026 to achieve compliance with the new legislation.

Attorney General Hon. Samuel Bulgin KC emphasized that the commencement of the Act marks the culmination of over two decades of efforts to modernize the legal framework in the Cayman Islands, ensuring that all lawyers are subject to the same set of rules.
