IHREC to Contest State's Appeal on Asylum Seekers' Rights

The Irish Human Rights and Equality Commission (IHREC) has announced its intention to fully contest the State's appeal against a High Court ruling that found the government failed to provide for the basic needs of unaccommodated international protection applicants, thereby breaching their right to dignity.

The original High Court case, initiated by IHREC in December 2023, addressed the plight of 259 asylum seekers who were left without accommodation upon their arrival in Ireland. The court's decision in August 2024 highlighted the State's shortcomings in meeting its obligations under both domestic and international human rights standards.

In November 2024, the State lodged an appeal against this ruling. IHREC, emphasizing the importance of upholding the rights and dignity of all individuals seeking protection, has committed to contesting this appeal in the Court of Appeal proceedings scheduled for March 6 and 7, 2025.

This case underscores the ongoing challenges within Ireland's asylum system and the critical role of legal advocacy in ensuring that the rights of vulnerable populations are protected and upheld.
