The Appellate Division of the Supreme Court is set to deliver its order on a leave-to-appeal petition challenging a High Court verdict that upheld the government's decision to lease the New Mooring Container Terminal (NCT) at Chattogram Port to UAE-based DP World. The bench, led by Chief Justice Zubayer Rahman Chowdhury, concluded the hearing and scheduled the ruling for tomorrow.
The petition was filed by the Bangladesh Jubo Arthanitibid Forum, a philanthropic organization, seeking to maintain the status quo over the leasing process. The organization argues that executing the contract just before the election constitutes "manifest executive high-handedness, arbitrariness, and malafide exercise of power" by the government.
Previously, the High Court rejected a writ petition challenging the legality of the government's move to award the contract to DP World. The upcoming Supreme Court decision is anticipated to have significant implications for the management and operational control of one of the country's key maritime assets.
Stakeholders in the shipping and logistics sectors are closely monitoring the case, as the outcome could influence future foreign investments and the governance of critical infrastructure projects in Bangladesh. The decision will also serve as a precedent for how legal challenges to government contracts are addressed within the country's judicial framework.
As the nation awaits the Supreme Court's ruling, discussions about transparency, due process, and the balance of power between the executive and judiciary continue to be at the forefront of public discourse.
