Libya's Judicial Council Grants Pardon to Eligible Prisoners

The Supreme Judicial Council of Libya has issued a decision granting pardons to certain convicted inmates who meet specific conditions. To be eligible, prisoners must have served at least half of their sentence by March 18, 2026, paid all court-ordered restitution and fines, and must not be repeat or habitual offenders.

Exclusions from the Pardon

The decision excludes individuals convicted of embezzling public funds unless the misappropriated amounts have been repaid. It also excludes those convicted of drug trafficking, alcohol trafficking, crimes against state security, terrorism, murder, and other serious offenses unless the victim or their legal guardian formally waives their rights.

Implementation and Oversight

The Attorney General is tasked with directing public prosecutors to coordinate with relevant authorities to review inmates' files and prepare lists of those eligible for the pardon. The Supreme Judicial Council will resolve any issues or disputes arising from the implementation of the decision.

This move is seen as an effort to alleviate prison overcrowding and promote rehabilitation, while maintaining strict exclusions to ensure public safety and justice for victims.
